Case 2017-0002 Ordinance amending Anchorage Municipal Code Title 21 (New Code) to add a new method of subdivision called Unit Lot Subdivision. Fairview Community Council Comments: • The proposed Ordinance stated purpose is to allow fee-simple ownership of small lots associated with Townhouse and Cottage style housing development. • The narrative discusses the proposed changes moves the regulatory framework toward a condominium type of development. Condominiums allow a property owner to own a certain volume of air space within the developed envelope of a development. • The proposal will allow the division of existing lots into smaller fee simple lots while keeping the underlying zoning density allowances. • The proposal calls for establishment of homeowner associations and financial reserves. • It is requested staff submit clarifying language to the public record regarding the characteristics of these proposed Unit Lots. Specifically: o It appears the language would allow for a property owner of a typical lot in Fairview to sub-divide at greater density than current code permits. o For a 60 foot by 120 foot or 7,000 square foot lot, the maximum density is a four-plex in the middle of the lot with surface parking on both ends to service the four rental units. o The minimum lot size for R-3 is 2,000 square feet with minimum lot width of 20 feet, minimum front setback of 20 feet, minimum rear setback of 10 feet with 5 feet side yard setbacks and a maximum height of 35 feet. o This allows for a developable building envelope of approximately 157,000 cubic feet. o The minimum lot size of 2,000 square feet multiplied by a height of 10 feet equals 20,000 cubic feet. o Minimum parking requirements can be reduced by including a requirement in the Articles of Incorporation for the Homeowners Association for the purchase of Monthly Transit Passes. o There is a concurrent proposal to allow building heights to increase by an additional 15 feet for construction of rooftop greenhouses whose square footage can be used to meet minimum Open Space requirements. o Thus, it may be possible to create as many as eight Unit Lot properties using a combination of surface estate and condominium airspace versus four rental units on a typical Fairview lot. • This preliminary assessment does not address other zoning categories prevalent in the Fairview Council area. • The Council requests that clarifying language be inserted into the proposed Ordinance to make it clear to potential developers that the Unit Lot Sub-Division is applicable to the surface land estate only and does not apply to the sub-division of airspace within the lot. | |
